Problem
A company sustained a significant civil judgment, penalties, and fees by the government flowing out of a protracted environmental civil lawsuit.
Approach
Working independently of the client's law firm, we began a series of negotiations with the lawyers from the attorney general's office and officials within the government environmental agency in an effort to reduce the significant amount of the judgment, penalties, and fees. Displacing the client's argumentative lawyers, we found common ground between the client's needs and the government's interests.
Results
Both the government and the client got what they wanted after ample, peaceful discussions.
